Ten suggestions for anyone thinking of purchasing is Spain:

Ensure you use a reputable qualified Real Estate Agent with legal qualifications; an office may look good, but are they Nationally Qualified Professionals (Property Asesors)

Make sure any alterations to the property have the relevant licences and that the Deeds have been updated with the new description (if relevant).

Deposits are refundable if a contract is not signed. Simply to state deposits are non-refundable because you are in Spain is not correct.

If you are buying a property for its building potential you need to know that you can, in fact, build on it legally and for the purpose you intend.

Ensure you view the property before making an offer or sending a deposit.

Instruct a Solicitor/Asesoria that can speak both Spanish and English

Get a survey done to give you peace of mind.

The lawyer should check the following information as a minimum:

  • Check the details from the property against the Nota Simple to ensure they match.
  • Boundaries, plot size, the size and layout of the property on the Catastro Data Base (separate department to the Land Registry).
  • If there are any out-buildings.
  • If the property is registered rustic or urban.
  • If the land can be built on and if it has any restrictions in place.
  • If there are any registered debt.
  • Utilities and Council tax.

Any extra costs should be accounted for, such as: legal representation fees, Notary fees, Land Registry fees, local search certificates and the purchase tax. It is important to remember that the purchase tax can vary in different regions and is calculated either on the value registered at the Land Registry or the declared purchase price, whatever is the highest.

If you are buying land for a new build it is easy to obtain a document informing you of what can and cannot do on that specific plot. This can be obtained from the local Town Hall (Ayuntamiento) for a small admin fee, but can take some weeks to acquire.
